EPA Settles with City and Port of Oakland Over Claims of Civil Rights Violations

The U.S. Environmental Protection Agency (EPA) announced this week that it has entered into a final voluntary resolution with the City and Port of Oakland in response to a civil rights complaint filed by Earthjus­tice on behalf of the West Oakland Environmental Indicators Project.

The complaint stated that the City and Port of Oakland have been engaging in a pat­tern of conduct for decades that expanded freight activi­ty at the expense of increased pollution in predominantly Black communities in West Oakland Wednesday, after more than two years of negotiations, the final resolution acknowledges the problem, but lacks the meaningful requirements and real com­mitments by the City and Port of Oakland that are necessary to finally address the freight pollution crisis in the surrounding communi­ty, according to community advocates.

Under Title VI of the Civ­il Rights Act of 1964, recip­ients of federal funds, like the Port of Oakland, have an obligation to avoid actions that result in unjustified un­equal impacts on the basis of race, and to consider the risk of unequal impacts be­fore approving projects.

“The EPA has concluded that the Port of Oakland is violating our civil rights in West Oakland with the pollution they’re pumping into our air, but the agency hasn’t given us a plan with real teeth to make the Port do something about it,” said Brian Beveridge with the West Oakland Environ­mental Indicators Project (WOEIP). “The complaint brought us a lot more pro­cess, and several new plans, but we’re still waiting for the clear targets and mea­surable actions that will quell the toll on human health in West Oakland. It’s time for Mayor Schaff to do something about it.”

According to Marga­ret Gordon, also with W.O.E.I.P., “The City of Oakland has yet to form a budget or add the necessary staff to make policy deci­sions and provide public health protections for this community.”

Both the U.S. Environ­mental Protection Agency and the U.S. Department of Transportation agreed to ini­tiate an investigation of the complaint after it was filed in 2017, effectively agree­ing, along with virtually ev­ery state and regional public health agency, that the City and Port of Oakland cannot continue to ignore the im­pacts their decisions are hav­ing on this community. The final resolution represents a missed opportunity to re­duce deadly diesel emis­sions in West Oakland, say the W.O.E.I.P. leaders.

W.O.E.I.P., together with Earthjustice, say they will continue to push for greater protection and fairer treat­ment of the community surrounding the Port of Oakland and look forward to working with the city to achieve a forward-looking, zero-emis­sions port.

Adrienne Shelton has a way of putting herself in others’ shoes.

As a PG&E employee recently marking 20 years with the company, she works to resolve billing issues with large customers. In her hometown of Oakland, she’s on the lookout for ways to make a difference, volunteering at her church, her kid’s school, and as she says, “just anywhere.”

If anyone’s looking for an example of being empathetic, look no further.

‘Our customers come first’

As a customer success manager, Adrienne supports her coworkers who work with large agricultural and industrial customers. When someone has a billing issue that’s been escalated by an account manager, Adrienne works to “resolve these concerns before they become bigger issues.”

Recently, PG&E changed the billing format for customers who are manually billed. In the past, they got two bills: one that summarized everything and one that was more detailed and broke down the various billing components. The new format has everything on one bill.

“Some of our customers create internal reports based on how we presented the information,” said Adrienne. “But now, they’re not seeing the detail as they had in the past. They’ve had problems reconciling their books. Change can be hard. They’re used to seeing things in a certain way.

“I put myself in their shoes,” she added. “I ask myself what would make me satisfied? I make sure our customers come first.”

Besides being empathetic, Adrienne consistently shows characteristics valued at PG&E: tenacity, curiosity, and ownership.

“Much of my role involves encouraging people to accomplish tasks and working with internal partners to implement changes,” said Adrienne. “For example, I might say, ‘This customer requires their information formatted in a certain way. Even if only a few customers need this, it’s essential for them to balance their numbers and keep their businesses running.’

“I reach out to anyone necessary to ensure we can implement the change, and I don’t accept ‘no’ easily,” she continued. “I’ll escalate the issue as far as possible until I determine it truly can’t be done.”

Adrienne enjoys solving problems. When a customer explains their needs, she views it as an opportunity rather than a challenge.

“That’s part of why I enjoy my job,” she explained. “Each day brings something different, and we get to work out how to find solutions.”

Making a difference in the community

Not only does Adrienne practice being empathetic at work, but she also brings that trait to her community in Oakland.

“My church has a feeding ministry that feeds the community twice a week,” said Adrienne. “I go as often as I can. For Thanksgiving, I took my kids and family and we served dinner to the homeless.”

Adrienne has also been a member of the company’s Black Employee Resource Group for 19 of her 20 years. This past year, one of her ERG responsibilities was supporting the scholarship program, which provides awards to college-bound students.

“The students are very appreciative when they get their scholarship checks and have someone follow up with them,” she said. “It’s important to make a difference in their lives.”

Perhaps Dr. Martin Luther King Jr. would be proud of Adrienne, who honors his legacy by making service a part of her life—not just for one day, but every day. On Jan. 19, Adrienne and her family will take the Celebration Train from San Jose to San Francisco and then participate in the annual march through the city to honor King’s birthday.

Her motivation is deeply personal. Her father grew up in segregated Arkansas, and his stories shaped her understanding of resilience, justice, and gratitude.

“It’s important for my kids to know their history and how fortunate we are to be in this time and place,” she said. “We’re so blessed to have many of the things we have. It’s important we don’t take any of that for granted.”

For more than 25 years, Desmond Gumbs has been a cornerstone of Bay Area education and athletics — not simply as a coach, but as a mentor, founder, and architect of opportunity. While recent media narratives have focused narrowly on challenges, they fail to capture the far more important truth: Gumbs’ life’s work has been dedicated to building pathways to college, character, and long-term success for hundreds of young people.

A Career Defined by Impact

Gumbs’ coaching and leadership journey spans from Bishop O’Dowd High School, Oakland High School, Stellar Prep High School. Over the decades, hundreds of his students have gone on to college, earning academic and athletic scholarships and developing life skills that extend well beyond sports.

One of his most enduring contributions is his role as founder of Stellar Prep High School, a non-traditional, mission-driven institution created to serve students who needed additional structure, belief, and opportunity. Through Stellar Prep numerous students have advanced to college — many with scholarships — demonstrating Gumbs’ deep commitment to education as the foundation for athletic and personal success.

A Personal Testament to the Mission: Addison Gumbs

Perhaps no example better reflects Desmond Gumbs’ philosophy than the journey of his son, Addison Gumbs. Addison became an Army All-American, one of the highest honors in high school football — and notably, the last Army All-Americans produced by the Bay Area, alongside Najee Harris.

Both young men went on to compete at the highest levels of college football — Addison Gumbs at the University of Oklahoma, and Najee Harris at the University of Alabama — representing the Bay Area on a national level.

Building Lincoln University Athletics From the Ground Up

In 2021, Gumbs accepted one of the most difficult challenges in college athletics: launching an entire athletics department at Lincoln University in Oakland from scratch. With no established infrastructure, limited facilities, and eventually the loss of key financial aid resources, he nonetheless built opportunities where none existed.

Under his leadership, Lincoln University introduced:

  • Football
  • Men’s and Women’s Basketball
  • Men’s and Women’s Soccer

Operating as an independent program with no capital and no conference safety net, Gumbs was forced to innovate — finding ways to sustain teams, schedule competition, and keep student-athletes enrolled and progressing toward degrees. The work was never about comfort; it was about access.

Voices That Reflect His Impact

Desmond Gumbs’ philosophy has been consistently reflected in his own published words:

  • “if you have an idea, you’re 75% there the remaining 25% is actually doing it.”
  • “This generation doesn’t respect the title — they respect the person.”
  • “Greatness is a habit, not a moment.”

Former players and community members have echoed similar sentiments in public commentary, crediting Gumbs with teaching them leadership, accountability, confidence, and belief in themselves — lessons that outlast any single season.

Context Matters More Than Headlines

Recent articles critical of Lincoln University athletics focus on logistical and financial hardships while ignoring the reality of building a new program with limited resources in one of the most expensive regions in the country. Such narratives are ultimately harmful and incomplete, failing to recognize the courage it takes to create opportunity instead of walking away when conditions are difficult.

The real story is not about early struggles — it is about vision, resilience, and service.

A Legacy That Endures

From founding Stellar PREP High School, to sending hundreds of students to college, to producing elite athletes like Addison Gumbs, to launching Lincoln University athletics, Desmond Gumbs’ legacy is one of belief in young people and relentless commitment to opportunity.

His work cannot be reduced to headlines or records. It lives on in degrees earned, scholarships secured, leaders developed, and futures changed — across the Bay Area and beyond.

Oakland School Board Grapples with Potential $100 Million Shortfall Next Year

The Oakland Board of Education is continuing to grapple with a massive $100 million shortfall next year, which represents about 20% of the district’s general fund budget.

The school board approved Superintendent Denise Saddler’s plan for major cuts to schools and the district office, but they are still trying to avoid outside pressure to close flatland schools.

Without cuts, OUSD is under threat of being taken over by the state. The district only emerged from state receivership in July after 22 years.

“We want to make sure the cuts are away from the kids,” said Kampala Taiz-Rancifer, president of the Oakland Education Association, the teachers’ union. “There are too many things that are important and critical to instruction, to protecting our most vulnerable kids, to safety.”

The school district has been considering different scenarios for budget cuts proposed by the superintendent, including athletics, libraries, clubs, teacher programs, and school security.

The plan approved at Wednesday’s board meeting, which is not yet finalized, is estimated to save around $103 million.

Staff is now looking at decreasing central office staff and cutting extra-curricular budgets, such as for sports and library services. It will also review contracts for outside consultants, limiting classroom supplies and examine the possibility of school closures, which is a popular proposal among state and county officials and privatizers though after decades of Oakland school closures, has been shown to save little if any money.
